Coventry v Lawrence: Nuisance and planning permission in the UK Supreme Court: from the Court of Appeal

There are recognised causes of action beyond the contractual, (or asserting rights in property) which in the University sector it is easy to become preoccupied with. This week in the UK Supreme Court, on appeal from the Court of Appeal, is a case involving the tort of nuisance, tied up in a planning permission. Coventry v Lawrence involves nuisance created from motor sports, and the issue whether the grant of planning permission sanctions any nuisances flowing from the permitted activity.

As every student of the law knows, In Miller v Jackson [1977] QB 966 (nuisance created by the sport of Cricket) Lord Denning MR began his judgment in classic style: ‘In Summertime, village Cricket is the delight of everyone.’ Doubtless Miller v Jackson is a case of its time, but Lord Denning’s judgment is a good frame of mind to begin any query into the law of ‘nuisance’.

West Midlands Production Fund

This fund is not really research, but may be of interest to some of the film and TV production academics as it supports the production of feature films of all genres including documentaries and animation; and TV drama series, serials and one offs with a slot length longer than 30 minutes.

It is specifically focused on productions in the West midlands

Scheme: West Midlands Production Fund

Overview: Fund which invests in the production of feature films and high-end TV drama from companies based in the West Midlands as well as from producers looking to establish a base and film in the region.

Budget: They are planning to support between four and five productions over the next 18 months, with investments of up to £500,000 per project.

The AXA Research Fund invites applications for its chairs programme. Grants enable institutions to attract one or more world-class researchers to undertake teaching alongside research work. The researcher may address the following topics:

environmental risks, including natural hazards, human-driven environmental changes and risks linked to climate change;

life risks, including ageing and long-term care, addictions and risky behaviours and biomedical risks;

socio-economic risks, including geopolitical risks, macro-economic and systematic financial risks, individual and collective behaviours when facing uncertainties, and large corporate risks.

Applications are welcomed from research institutions in the European Union as well as from 40 other countries.

Chair positions may request up to €2.5 million, while funding for the successional chair programme is worth up to €1.8m.

MacRobert Award

The premier award for UK innovation in engineering

The MacRobert Award recognises the successful development of innovative ideas in engineering. It seeks to demonstrate the importance of engineering and the role of engineers and scientists in contributing to national prosperity and international prestige.

The Award, first presented in 1969, honours the winning organisation with a gold medal, and each of the individual nominees with a bronze medal. There is, in addition, a cash prize of £50,000.

Originally founded by the MacRobert Trusts the Award is now presented by The Royal Academy of Engineering, a prize fund having been established with donations from the MacRobert Trusts, The Royal Academy of Engineering and British industry.

Volkswagen v Garcia: Academic publication and interaction with commercial interest

Please find attached a link to an interesting short discussion of the Injunction case of Volkswagen v Garcia, heard in the Intellectual Property Enterprise Court before Justice Birss (formerly the Patents County Court) in June 2013, from the Lexology legal feed; illustrating that there are limits to freedom of academic publication when balanced against legitimate commercial interests. Further discussion of the Volkswagen injunction, involving UK academics will follow in a later blog.

Funding: Use ICT to improve the Learner Experience

JISC are looking to fund projects that will use new technologies to improve the learning experience for students. Following a change to its funding, this is the first call JISC has launched in a long time. The University has had considerable success with JISC funding in the past, and their schemes suit the universities strongly student orientated approach.

Funding Body: JISC

Scheme: Innovation through technology funding call

Overview: Jisc is starting a new million pound funding programme to improve the learner experience and increase the capability and capacity of the workforce across further education and skills providers. Money will be awarded to projects which encourage, support and promote innovation within the sector.

They are looking to fund innovative projects to:

  • Integrate new technologies in learning and teaching, assessment and business activities
  • Overcome barriers to the adoption and use of technology in the sector
  • Develop new uses for technology or innovative adaption and rollout of technologies.

The sorts of things they are looking to fund include:

  • Creating resources, tools or products
  • Developing organisational and collaborative processes using digital technologies
  • Developing apps
  • Creating augmented reality resources
  • Improving or adapting current technologies and resources (some already available through Jorum)
  • Developing new uses for technologies

Budget: £5,000 to £100,000 depending upon the scale of the project and numbers of providers involved in the areas outlined above.

Deadlines: Deadline for submissions is Friday 6 December 2013 at 12:00 noon.

A redistribution of societal risk: the impact on individuals, their networks and communities

This call is for an analysis of current and recent policy and evidence to assess the effects that recent changes in the redistribution of societal risk have had on people’s lives and relationships, particularly those that will have significant implications in our ageing society.

JRF are interested in assessing the cumulative impact of these shifts on individual lives, and the knock-on effects of them on others (e.g. family members) in the directly affected person’s network. They also want to look at the risks of redistributing responsibility for community resources – what are the effects on individuals, their personal networks and communities?

The budget for this project is up to £40,000 (including VAT and expenses).
